Terms of Service

These Terms of Service ("Terms") govern your use of Property Hunter (the "Service"), operated by Apex Technologies ("Apex Technologies", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and account

You must be at least 18 years old and able to enter into a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. Free trial and subscription billing

• Some plans offer a free trial. If you do not cancel before the trial ends, your paid subscription begins automatically at the then-current price.
• Subscriptions renew automatically for successive billing periods (monthly or annual, depending on the plan you choose) until cancelled.
• You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; unused time in the current period is not refundable except where required by law.
• Prices and features may change. We will give reasonable prior notice of any material price change.
• All fees are exclusive of taxes, which you are responsible for where applicable.

3. Acceptable use

You agree not to:

• Scrape, crawl, or otherwise access the Service by automated means except through interfaces we expressly provide.
• Resell, sublicense, or provide the Service to third parties as a standalone product.
• Interfere with or disrupt the Service, attempt to gain unauthorized access, or probe it for vulnerabilities without written permission.
• Use the Service to violate any law, third-party right, or the terms of any upstream data provider (including but not limited to listing sources).
• Upload or transmit malware, spam, or content that is unlawful, abusive, or infringing.

4. Estimates only — do your own due diligence

Property Hunter surfaces estimated financial metrics — including rent, cap rate, cash-on-cash return, DSCR, ARV, rehab costs, and cash flow — derived from third-party data and simplified models. These are estimates for informational purposes only, are not appraisals, and are not financial, investment, legal, tax, or real-estate advice. Real-world results will differ. Before purchasing, renting, financing, or otherwise transacting on any property, you must perform your own independent due diligence, including verifying property condition, comparables, rent, expenses, zoning, and any applicable laws, and consulting your own qualified advisors. You are solely responsible for your investment decisions and outcomes.

5. Third-party data and services

The Service integrates with third parties (for example, listing data providers, payment processors, and email delivery). We do not warrant the accuracy, availability, or continued operation of any third-party data or service, and are not responsible for their content or acts.

6. Intellectual property

The Service, including its software, design, and content we create, is owned by Apex Technologies and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the data you upload; you grant us a limited license to host, process, and display that data solely to operate and improve the Service for you.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY FINANCIAL METRIC WILL PROVE ACCURATE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEX TECHNOLOGIES AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR INVESTMENT LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless Apex Technologies from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.

10. Termination

You may stop using the Service and cancel your subscription at any time from your account settings. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. Provisions of these Terms that by their nature should survive termination will survive.

11. Changes to the Service or Terms

We may modify or discontinue features of the Service at any time. We may update these Terms; material changes will be posted on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.
